According to a report by Publico, the PSP police have confirmed that fines are being issued to foreigners who have overstayed their visas, however, the fines issued are not €700 as provided for in Article 192 of the Foreigners law, but instead amount between €40 and €250.
“No foreign citizen has received sines of €700, the maximum amount provided by the law”, this amount would only be applied if a case of fraud had been detected by the authorities.
The law states that fines can be applied for those who stay in Portugal for a period longer than that permitted, and the amount depends on the extent of the overstay.
According to the police, a fine of “€80 to €160 is applied if the period does not exceed 30 days: from €260 to €320 if the period of stay exceeds 30 days but does not exceed 90 days; from €320 to €500 if the period exceeds 90 days; but does not exceed 180 days; and from €500 to €700 if the period exceeds 180 days”.
The PSP states that this law and the associated fines apply to both tourists who have extended their stay in Portugal, normally up to 90 days, extendable for a further 90 days, and “in situations where it is demonstrated or the person declares that they exercise or have exercised any activity that requires a specific visa”.
I was fined 600 for being over 180 days but it was during covid and I had started my residence process. This process was canceled and rescheduled for a later date, which was canceled again 2 more times. So when I finally got to SEF of course I was over. But I had my own apartment and had moved everything here. Even to fly home was impossible because I had not had the vaccine to get the certificate needed to fly. I even received a letter telling me I would be deported but fortunately it did not happen. I did get into SEF finally and did get a residence permit. But the stiff penalty was a surprise because I did not cancel, I did not cause covid, but the rules are the rules attitude sticks.

I find this confusing because if a person goes to the AIMA website https://aima.gov.pt/pt/documentos-e-vistos-validos-e-aceites-ate-30-de-junho-de-2025-valid-and-accepted-documents-and-visas-until-30-june-2025 It seems to say that almost anyone can stay until June 30, 2025. Am I missing something or misunderstanding what this document is stating?

And they should, as a minimum, be fined. A decade ago I was fined €750 for leaving Germany 1 day late; not caught on the street, but departing late due to a flight cancellation.
Break a contract or the law, but be prepared to pay.

This country is a joke! Yesterday, I finally had an appointment at AIMA to renew my residence permit. After 2 years of trying to make an appointment. With 1 number to go, their system crashed and they told everyone who was waiting that we have to reschedule our appointments... Which is of course again impossible since the online system does not have any available dates. It always shows the same message. Its totally absurd and pathetic. I need this document to renew my passport... Soon I'll be really f..ked
